Acceptance of terms

These Terms of Use govern your use of the website operated by IMD Insurance Agency LLC (“IMD,” “we,” “us”). By using this website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

Information only — not an offer

Content on this website is provided for general informational purposes. It is not an offer to sell, or a solicitation to buy, insurance in any jurisdiction where we are not licensed, and it is not legal, tax, accounting, or regulatory compliance advice. Coverage descriptions are summaries; the terms of an issued policy control. Products may not be available in all states, and all coverage is subject to underwriting and insurer approval.

No binding through the website

Submitting a form, sending an email or text, or leaving a voicemail does not bind, change, or cancel any insurance coverage. No coverage is in effect, and no change to coverage is effective, until you receive written confirmation from IMD or the insurer.

Electronic communications

By contacting us electronically, you consent to receive communications from us electronically, including by email, and agree that such communications satisfy any legal requirement that they be in writing, to the extent permitted by law. Text messaging requires your separate, express opt-in and is governed by the Text Message Program Terms below.

Text Message Program Terms

Program name: IMD Insurance Agency insurance service messages, operated by IMD Insurance Agency LLC, 767 Broadway #1239, New York, NY 10003.

Description: one-to-one service text messages (SMS/MMS) about your own insurance quote, policy servicing, certificates of insurance, renewals, requested documents, and appointment reminders. We do not send marketing campaigns by text.

Opting in: you opt in by checking the separate SMS consent box on a form on this website or on our text updates page, by giving verbal consent on a recorded call, or by texting us first. Consent is not a condition of purchase. You must be 18 or older and the account holder or authorized user of the mobile number.

Message frequency varies. Message and data rates may apply.

  • STOP — reply STOP (or END, CANCEL, UNSUBSCRIBE, or QUIT) to any message to opt out. We will send one confirmation message and then stop sending texts to that number. You can also opt out by calling or emailing us.
  • START — reply START (or UNSTOP, YES) to re-enroll after opting out.
  • HELP — reply HELP for help, or contact us at (332) 333-2353 or ivan@imd-insurance.com.

Carriers are not liable for delayed or undelivered messages. Supported carriers include major U.S. carriers; availability may vary.

Privacy: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with, sold to, or used by any third party, affiliate, or lead generator. See our Privacy Policy.

Acceptable use

You agree to provide accurate information and not to: use the site for any unlawful purpose; submit false or misleading information; attempt to gain unauthorized access to our systems; interfere with the site's operation; or scrape, harvest, or copy content by automated means without permission.

Intellectual property

The website, including its text, design, graphics, and logos, is owned by or licensed to IMD and is protected by intellectual property laws. You may view and print pages for your personal or internal business use. Any other use requires our written permission. Insurer names and marks belong to their respective owners.

The site may link to third-party websites, such as government regulators and the FMCSA. We do not control and are not responsible for their content, policies, or practices.

Disclaimers & limitation of liability

The website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, IMD will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the website.

Nothing in these Terms limits any duty or obligation we owe you as a licensed insurance producer under applicable insurance law, or any liability that cannot be limited by law.

You agree to indemnify IMD against claims arising from your misuse of the website or violation of these Terms.

Governing law & changes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute relating to the website will be brought in the state or federal courts located in New York County, New York. If any provision is found unenforceable, the remaining provisions remain in effect. We may update these Terms at any time by posting a revised version on this page.
